29 CFR 1926.25(a):     During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.    On or about April 26, 2012 at the worksite, buidling materials and scrap such as but not limited to pieces of shinges and lumber were not cleared from the work area. The materials covered the roof of the house that was in the process of being shingled. The materials presented a significant tripping hazard and employees were not utilizing any form of fall protection.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.     At the worksite, employees performing roofing activities on an approximate 5:12 pitch roof were not protected from the hazard of falling. The employees were shingling the roof with asphalt shingles and were observed working at the edges and peak of the roof. No alternative means of fall protection were provided. This condition exposed employees to the hazard of falling from a height of greater than six (6) feet.

29 CFR 1926.1053(b)(22):     An employee shall not carry any object or load that could cause the employee to lose balance and fall.   [55 FR 47689, Nov. 14, 1990; 56 FR 2585, Jan. 23, 1991; 56 FR 41794, Aug. 23, 1991]    On or about April 26, 2012, employees at the worksite were observed carrying bundles of shingles on their shoulders while ascending an aluminum ladder. This condition exposed employees to the hazard of loosing their balance and falling.
