29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):  The employer does not protect its employees from falling by a guardrail system, safety net system, or personal fall arrest system while employees are working from heights. This violation was observed on or about May 3, 2012, located at the work site at 111 Bella Vista, Shenandoah, TX, where two employees were exposed to an approximately 10 foot fall while installing plywood decking on the roof of a newly constructed two-story home without a fall protection system.  OSCAR BRAVO ROOFING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 329573, CITATION NUMBER 1 ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 24, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 1105 24TH ST., HOUSTON, TX. 77009.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling to lower levels.
