Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm in that employees were exposed to struck-by hazards when operating an overhead hoist:    a)	North Shop: On or about April 12, 2012, and at times prior thereto, there was no rated load legibly marked on the Wright Manufacturing Company manually operated overhead (underhung) hoist which was used by workers to move truck engines.    b)	North Shop: On or about April 12, 2012, and at times prior thereto, the employer had not performed frequent and periodic inspections on the Wright Manufacturing Company manually operated overhead (underhung) hoist which was used by workers to move truck engines.    Note: Abatement certification is required for this item.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    a) South shop, west wall; on or about April 12, 2012 and at times prior thereto, the outside edge of an open sided platform more than 8 ft. above the next lower level and used for parts storage was without a standard railing.    Note: Abatement certification IS required for this item.

29 CFR 1910.215(b)(9): Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel.     a) West wall of the maintenance garage on or about April 12, 2012 and at times prior, the adjustable tongue guard for the 10" stationary bench grinder was missing.
