29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):    On or about May 03, 2012, employees worked from a scaffold that was not fully planked on all working levels or at the corners where the scaffolds changed direction.  Employees were exposed to a fall hazard.

29 CFR 1926.451(c)(2)(ii): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills that were stable:    On or about May 03, 2012, The employer did not ensure that scaffold systems were supported by stable material or stable ground.  Employees worked from a scaffold that was supported by bricks and other material exposing the employees to a fall hazard.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).      On or about May 03, 2012, employees performing masonry activities on a scaffold system were not protected from falling to the lower levels or the ground by personal fall protection or fall protective systems.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.    On or about May 03, 2012, employees performing masonry activities from a scaffold system were not provided with a ladder for access and/or egress to and from the upper working levels.  Employees climbed the end frames and cross bars and were exposed to fall hazards.     Esequiel Suarez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 314175738, citation number 1, item number 3 and was affirmed as a final order on 04/22/2010 with a final abatement date of 04/21/2010, with respect to a workplace located at 3611 Swiss lane, Irving, Texas.
