29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about May 2, 2012, employees were exposed to cave-ins while they worked in a trench which was not protected from cave-ins by an adequate protective system. Employees worked in a trench which was approximately 20-25 feet deep and 3.5 feet wide with walls cut straight at approximately a 90 degree angle to the base of the trench. There was some visible undercutting and large areas of the trench had no shoring or protective systems.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) On or about May 2, 2012, employees were exposed to cave-ins while they worked in a trench which had not been inspected by a competent person that could recognize and correct hazards. The trench was approximately 20-25 feet deep and 3.5 feet wide with walls cut straight at approximately a 90 degree angle to the base of the trench. There was some visible undercutting and the trench did not have an adequate protective system.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: a) On or about May 2, 2012, employees were exposed to cave-ins while they worked in a trench that had about a foot of water at the base and was not protected from cave-ins by an adequate protective system. The trench was approximately 20-25 feet deep and 3.5 feet wide with walls cut straight at approximately a 90 degree angle to the base of the trench. There was some visible undercutting and large areas of the trench had no shoring or protective systems.
