29 CFR 1926.651(k)(2):   Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    Site: Corner of Nevins Street & Union Street Brooklyn, NY    On or about 5/4/12    a) When the employer found evidence of an unsafe condition due to the excavation being over 5 feet deep in soft soil without sloping or shoring, the condition was not corrected.

Site: Corner of Nevins Street & Union Street Brooklyn, NY    On or about 5/4/12    a) The excavation was approximately 5 feet 1 inch to 6 feet deep and was not provided with shoring or adequate sloping to protect the mployees from a cave-ins.
