29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818 Delilah Road, Egg Harbor Twp., NJ:  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards. Employees were observed using ladders incorrectly, working around unguarded wall openings, and working at elevated heights without the use of fall protection, occurred on or about 5/3/2012.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Employees were observed using step ladders as extension ladders and the top step of a step ladder, occurred on or about 5/3/12.         NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

(a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818 Delilah Road, Egg Harbor Twp., NJ: Employees were setting roof trusses without the use of fall protection, an approximate 20 foot exterior fall and a 10 foot interior fall, observed on or about 5/3/2012.         NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
