OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards. (a) The employer exposed employees to crushing hazard by not requiring the load (Centrifuge S/N: 1838260611, Model: CS18-3DM.GB) to be blocked before removing the slings or other lifting devices. (b) Adequate care was not exercised when removing/repositioning a sling from under the landed load (Centrifuge S/N: 1838260611, Model: CS18-3DM.GB) exposing employees to crushing hazards.

29 CFR 1910.179(n)(3)(iii)(b): During hoisting, the load contacted obstructions: (a) On or about May 4, 2012 at approximately 11:30 am; care was not taken when moving the Centrifuge Model CS183 DM with the 10 Ton capacity S/N: 1254-1 overhead under hung crane. The load contact items such as but not limited to the balancer, electrical panel, and Miller wire welder. This exposed employees to struck-by hazards.
