29 CFR 1910.134(d)(1)(i): The employer shall select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed and workplace and user factors that affect respirator performance and reliability. On 24 April, 2012 at the jobsite located at 8300 Barry Road in Kansas City, MO employees were exposed to a contact hazard with toxic substance in that the proper respirator was not provided to protect from workplace factors on site.

29 CFR 1910.134(k)(1)(vii): Training and information. This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so. On 24 April, 2012 at the jobsite located at 8300 Barry Road in Kansas City, MO employees were exposed to contact to toxic hazard in that employees were not trained on maintenance procedures for respirators in use. Respirator was not maintained according to manufacturers specifications.
