Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized struck-by and/or crushed-by hazards that are causing or are likely to cause death or serious physical harm to his employees:    This violation occurred on May 04, 2012, at a workplace located at 3700 Sylvan Avenue, Dallas, Texas 75212; where employees were exposed to the hazards of being struck-by and/or crushed-by the rotating superstructure of a track-mounted hydraulic drill rig.  The employer had erected and maintained some railings and safety barriers.    Among other methods, feasible and acceptable means to abatement the hazard(s) is to erect and maintain control lines, warning lines, railings or similar barriers to mark the boundaries of the swing radius; or, in situations where it is not possible to barricade the swing radius, the employer must take all of the alternative preventative measures:   (1)Pointing out the swing radius danger by posting signs, (2) Instructing the operators to swing only on signals from the foreman or the designated signal man, and (3) requiring employees not to move a rig until they know the area is clear would apprear to implement adequate alternative precautionary measures.    Persuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with this standard, including describing the steps it is taking to ensure that employees are protected from entering into the swing radius of track-mounted hydraulic drill rigs.

29 CFR 1926.251(a)(6): Each day before being used, during use, and where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:    This violation occurred on May 04, 2012, at a workplace located at 3700 Sylvan Avenue, Dallas, Texas 75212; where the safety latch at the throat of the hook on the wire rope sling was missing.    Persuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with this standard, including describing the steps it is taking to inspection slings, and ensure that damaged or defective slings are immediately removed from service.    This violation was corrected during the inspection.
