OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when production employees were operating various forklifts beyond they operational capacity.    On or about 5/2/2012, in the production area, Powered Industrial Truck operators are using various capacity forklifts (up to 8,000 lbs. capacity) to lift/pivot the "coolant houses" being assembled. In doing so the forklifts are overloaded and are tipping forward on to two wheels only which is prohibited in all of the forklift manufacturer's specifications.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.38(c)(2): An emergency action plan must include at a minimum: Procedures for emergency evacuation, including type of evacuation and exit route assignments.    On or about 5/2/2012, at the Conyers facility, when the employer elected to implement an Emergency Action Plan for employees, the plan did not include procedures of what to do in the event of a weather related emergency.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter.    On or about 5/2/2012, at the Conyers facility, employees appointed to use fire extinguishers on incipient level fires were not provided fire extinguisher training on an at least annual basis. The last training for fire extinguisher use was conducted on 2/15/2008.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about 5/2/2012, in the welding department of the production area, employees adjacent to and walking by the welding department were exposed to welding rays in that the employer did not provide adequate screeens in the area for protection. 29 CFR 1910.1030(f)(1)(i): The employer did not make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure.    On or about 3/14/2012, an employee was occupationally exposed to blood borne pathogens after responding to an incident involving another employee who had received a laceration. The employee was not offered the hepatitis B vaccination before or after the occupational exposure to blood borne pathogens. Other appointed 1st Responders at the facility have not been offered the hepatitis B vaccination.
