29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about May 11, 2012, employees in Roll Mesh, Wire Drawing, and Mat Mesh areas were exposed to hearing loss and the employer failed to effectively implement a hearing conservation program. Employees were exposed to noise levels at or above 85 dBA as 8-hour time-weighted averages while performing wire drawing and mesh making operations in the following instances:      a. A Roll Mesh Machine Operator, was exposed to continuous noise levels at 173% of the 8-hour Time- Weighted Average (TWA) Action Limit (85 dBA). The equivalent dBA level of 173% is approximately 94 dBA. The sampling was performed for 459 minutes during one shift. Zero exposure was assumed for the unsampled period of time, 21 minutes.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.132(a):     Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    On or about May 11, 2012, employees in the Outside Storing/Loading Area were exposed to falls of 15 feet to concrete surfaces while performing loading and storage operations. Employees were climbing and walking on stacks of mesh to secure the mesh packs to the lifting apparatus, and the employer failed to effectively implement fall protection.      Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(m)(5)(iii):     When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement:    On or about May 11, 2012, employees in the Outside Storing/Loading Area were exposed to struck-by hazards from dismounting a forklift with the load engaging means not fully lowered, controls not neutralized and the breaks not set to prevent movement.     Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
