29 CFR 1926.651(b)(4): While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees:  (a)  On April 13, 2012, at a jobsite located at E 11th St and Charlotte St., Kansas City, MO., The employer did not ensure that underground utility installations had been properly protected, or supported to protect the employees working in the excavation. Protective conduit covering the Utility lines had been broken and damaged.        Abatement certification for this violation is not required.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)  On April 13, 2012, at a jobsite located at E 11th St and Charlotte St., Kansas City, MO., The competent person had not taken necessary precautions to ensure the safety of the 11 ft. deep excavation, in that exposed employees had not been removed or protected from the hazardous conditions of the excavation.      Abatement certification for this violation is not required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  (a)  On April 13, 2012, at a jobsite located at E 11th St and Charlotte St., Kansas City, MO., an employee working in an excavation approx. 11 ft. in depth, was not protected from cave-in by an adequate protective system. As a result, the employee was exposed to death or serious struck by and or engulfment injuries due to potential cave in.         Abatement certification for this violation is not required.

29 CFR 1926.1053(b)(1) - Portable ladders being used for access to an upper landing surface did not extend at least 3 feet (.9 m) above the upper landing surface.      On April 13, 2012, at a jobsite located at E 11th St and Charlotte St., Kansas City, MO., employees working in an 11ft excavation were using a 12 ft. portable ladder which could not be extended 3ft above the landing surface. Employees were exposed to potential fall hazards of approx. 11 feet from the top ladder access point.         Abatement certification for this violation is not required.
