29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a)  On or about April 13, 2012, at jobsite located at 4126 S. Calumet Avenue, Chicago, IL. - the employer failed to develop a written hazard communication program for employees required to work with chemicals, including but not limited to Portland Cement and Siilca, thereby exposing employees to chemical hazards.

29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a)  On or about April 13, 2012, at jobsite located at 4126 S. Calumet Avenue, Chicago, IL. - An employee using Quikrete containing Portland Cement and Silica, was not using appropriate personal protective equipment, including, but not limited to a respirator gloves, and other protective items, whiling mixing and handling the product for concrete work, thereby exposing the employee to health hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:    a)  On or about April 13, 2012, at jobsite located at 4126 S. Calumet Avenue, Chicago, IL. - An employee performing roofing activities on a roof with an 8:12 pitch was not protected from falls, thereby exposing the employee to fall hazards of approximately twenty five (25) feet.
