29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: The employer does not protect employees in areas of impact or falling objects with protective helmets. This violation was observed on or about May 10, 2012, on the residential site of newly built homes where employees were exposed to a struck by hazard when masonry bricks positioned above without a protective helmet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. The employer does not provide employees with access to the scaffold. This violation was observed on or about May 10, 2012, on the east side of a newly built house where employees were exposed to a fall hazard when accessing the platform without a ladder.

This violation was observed on or about May 9, 2012, on the east and north sides of a newly built house where employees were exposed to a fall hazard when required to conduct brick masonry from a scaffold of 13 feet without a guard rail system.
