29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Adjacent to sidewalk and roadway, north to south; On or about May 10, 2012 and at times prior thereto, two employees installing slip joint PVC pipe for a high pressure sprinkler system were working in an excavation ranging from 4.8 to 5.6 feet in depth and 18 inches wide with vertical walls. One employee climbed up the excavated wall to exit and the other employee traveled approximately 70 feet to where the excavation was shallow enough to allow him to climb out. Note: Abatement certification and documentation is NOT required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a) Adjacent to sidewalk and roadway, north to south; On or about May 10, 2012 and at times prior thereto, two employees installing slip joint PVC pipe for a high pressure sprinkler system were working in an excavation ranging from 4.8 to 5.6 feet in depth, only 18 inches wide with vertical walls and no means of protection.
