29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets.    a)  On or about 05/08/2012, and at times prior thereto, employees were exposed to head injuries.  Two employees were working from a scaffold, one employee on the upper work platform and the other on the lower platform.  Neither employee was wearing hard hats.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a)  On or about 05/08/2012, and at times prior thereto, employees were exposed to a fall of approximately 14 feet to the dirt ground below.  The employees were accessing the scaffolds top work platform by climbing the scaffold end frame.
