OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed while operating a Cushman Turf -Truckster, three (3) wheel powered industrial truck.    The employer did not ensure the employee spraying herbicide from a Cushman Turf -Truckster, three (3) wheel powered industrial truck (burden carrier) could be safely operated across the face of slopes and hillsides in violation of the manufacturer's instructions.    On or about May 10, 2012, while the employee was driving the Cushman Turf -Truckster at an angle up the side of a hill in the practice area of the golf course spraying herbicide. The vehicle roller over and crushed the employee underneath. The employee sustained multiple fractures and other serious internal injuries from the accident and he succumbed to these injuries at the hospital.
