On or about May 10, 2012, employees were exposed to struck-by hazards when employees were operating a soil compactor in a ditch that was approximately 5.3-5.5 feet deep x 5 feet wide with the spoil pile located at the edge of the ditch.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On or about May 10, 2012, employees were exposed to struck-by hazards when the drainage ditch was not inspected by a competent person able to recognized hazards such as, but not limited to, excavations deeper than five feet with no cave-in protection.
