29 CFR 1917.27(a)(1):     Employees other than those determined by the employer to be competent through training or experience were permitted to operate a crane, winch, or other power operated cargo handling apparatus, or power operated vehicle, or to give signals to the operator of hoisting apparatus.    T" Dock, Icicle Seafoods, Seward, AK (Nets being loaded onto the F/V Kaylor T):  On or about 8 May 2012 and times prior thereto, training on crane operation was not sufficient for the operator and maintenance staff in that:    Operators were not trained on the crane manufacturer's guidance on inspections and safe operations for the boom truck crane.  The employer did not have the manufacturer's operations manual for the crane and did not utilize the manufacturers guidance for safe crane operations and inspections in their training.

29 CFR 1917.45(b)(2):     The manufacturer's (or design) rated loads for the conditions of use shall not be exceeded.    On or about 8 May 2012, an employee was loading fishing nets onto a fishing vessel exceeding the manufacturer's load weight limitations of the mobile crane, causing the crane to tip on its side.  The load was not weighed prior to the operation.  This condition exposed employee to struck by and fall hazards.

29 CFR 1917.46(a)(1):     Except as provided in paragraph (a)(1)(viii) of this section, every crane after October 3, 1984 shall be fitted with a load indicating device or alternative device in proper working condition which shall meet the following criteria:    On or about 8 May 2012 and times prior thereto, an employee was loading fishing nets onto a fishing vessel without a load indicating device on a mobile crane.  The load being lifted exceeded the manufacturer's load weight limitations of the mobile crane, causing the crane to tip on its side.  This condition exposed the employee to struck by and fall hazards.

29 CFR 1917.45(k)(2):     A designated person shall thoroughly inspect all functional components and accessible structural features of each crane or device at monthly intervals.    On or about 8 May 2012 and times prior thereto, the designated person did not thoroughly inspect all of the crane's functional components as follows:         1. Lubrication of points required by Lubrication Chart.       2. Main frame mount bolts for proper torque.       3. Rotation system mount bolts for proper torque.       4. All welds for breaks and cracks.       5. Tighten cable clip bolts on end of loadline to 65 ft.-lbs.    This condition exposed the employees to struck by and fall hazards.

29 CFR 1917.95(b)(1):     The employer did not provide and direct the wearing of personal flotation devices for those employees engaged in work in which they may be pulled into the water.    On or about 8 May 2012 and times prior thereto, employees working on docks and fishing vessels were not wearing personal floatation devices (PFDs). This condition exposed employees to a drowning hazard.

29 CFR 1917.45(k)(4):     A record of monthly inspections was not maintained for 6 months in or on the crane or derrick, or at the terminal.    Icicle Seafoods, Seward AK:  On or about 8 May 2012 and times prior thereto, the employer did not have 6 months of inspection records for all cranes utilized in the facility.  Records of inspections for January and February 2012 were not available for three pedestal cranes on the dock side of the plant and "T" Dock for the following:  R.D. Stinger (#701C), Utility Body (#DOP32), Seattle Crane (#125) and a National Crane 4T46 boom crane (Serial #10919) mounted on a 1977 GMC Sierra 6500 flat-bed truck (VIN# TCE677V579949).
