29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equaled or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about May 11, 2012, employees in Detailing Area were exposed to hearing loss and the employer failed to effectively implement a hearing conservation program. Employees were exposed to noise levels at or above 85 dBA as 8-hour time-weighted averages while performing car interior detailing with compressed air in the following instances:      a. A detail specialist was exposed to continuous noise levels at 122% of the 8-hour Time- Weighted Average (TWA) Action Limit (85 dBA). The equivalent dBA level of 122% is approximately 91 dBA. The sampling was performed for 414 minutes during one shift. Zero exposure was assumed for the unsampled period of time, 66 minutes.    b. A detail specialist was exposed to continuous noise levels at 93% of the 8-hour Time- Weighted Average (TWA) Action Limit (85 dBA). The equivalent dBA level of 93% is approximately 90 dBA. The sampling was performed for 399 minutes during one shift. Zero exposure was assumed for the unsampled period of time, 81 minutes.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.242(b):     Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:    Employees in the Detail Area were exposed to lacerations from compressed air above 100 p.s.i. while performing interior car surface cleaning operations, and the employer failed to effectively reduce air pressure to less than 30 p.s.i.        There is no abatement certification or documentation required for this item.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    Employees in the Wash Bay, Buffing and Detail Areas were exposed to respiratory distress from cleaning chemicals that included Xylene and Petroleum Distillates while performing car wash, buffing and detailing operations, and the employer failed to effectively train employees on the hazards of the chemicals they are exposed to.      Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
