29 CFR 1910.1000(c): An employee was exposed to crystalline silica quartz, listed in Table Z-3. in excess of the Permissible Exposure Limit (PEL) as an 8 hour Time Weighed Average concentration: (a) Fab Area- One employee engaged in finishing Cambria counter top which involved wet grinding was exposed to crystalline silica at an 8 hour time weighted average of 1.120 mg/m3, approximately 1.308 times the calculated permissible exposure limit of 0.856 mg/m3 on or about May 10, 2012. The exposure level was derived from two samples collected over a period of 459 minutes. Zero exposure was assumed for the unsampled period of 21 minutes. Chronic exposure to silica may cause silicosis.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) Fab Area- One employee engaged in finishing Cambria counter top which involved wet grinding was exposed to crystalline silica at an 8 hour time weighted average of 1.120 mg/m3, approximately 1.308 times the calculated permissible exposure limit of 0.856 mg/m3 on or about May 10, 2012. The exposure level was derived from two samples collected over a period of 459 minutes. Zero exposure was assumed for the unsampled period of 21 minutes. Chronic exposure to silica may cause silicosis. A written respirator program which required the use of respirators when finishing countertops was not established or implemented. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
