29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:    (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: Employees without fall protection were working on top of the elevator shaft with an approximate 20 foot fall to the ground and wall openings with an approximate 10 foot fall to the next lower level; employees did not recognize the need for proper fall protection, on or about 5/3/2012.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training:      (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: Employees did not understand and recognize the hazards when improperly using the extension ladder when accessing the top of the elevator shaft; side rails did not extend above the upper landing surface, on or about 05/10/12;    (b) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: Employees did not understand and recognize the hazards of using the top step and top of the step ladder when installing the top plate for the second floor, on or about 5/10/2012.
