NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.    (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: The anchorage point was not installed under the supervision of a qualified person and was not installed in a manner which maintained a safety factor of at least two.  The anchorage did not contain the number of required screws to maintain the safety factor, observed on or about 5/10/12.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    (a) Jobsite located at Egg Harbor Care Center, project #5176-08, 6818-6820 Delilah Road, Egg Harbor Twp., NJ: The employee was wearing a shock absorbing lanyard that was connected to an 18 inch lanyard with a 5/8 inch rope grab, which was connected to a life line containing a shock pack. The 6 foot free fall distance was exceeded with the combination of those items, observed on or about 5/10/12.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
