29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  (a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(DESCRIBE HAZARDS WHERE NECESSARY, MATERIALS OR EQUIPMENT LESS THAN 2 FEET FROM EXCAVATION, AND WHAT PROTECTION SHOULD HAVE BEEN PROVIDED)      An employee at the job site located at 2378 Spring Mill Estates Drive in St. Charles MO on 14 Feb 2012 worked in the trench of the new home construction where the spoil pile was closer than 2 feet of the trench.      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that th  (a)(LOCATION)(DIMENSIONS OF THE EXCAVATION)(EMPLOYEES EXPOSED)(THE EMPLOYER HAD NOT MET ALL THE ELEMENTS OF SLOPING/BENCHING OPTION (2), -3 OR (4))  NOTE: THIS OPTION IS FOR USE WHEN SLOPING IS INADEQUATE. SEE CPL 2.87, DATED FEBRUARY 20, 1990, REQUIREMENTS FOR PROTECTIVE SYSTEMS, (d)(1)(a) AND (b), PAGE 13      An employee at the job site located at 2378 Spring Mill Estates Drive in St. Charles MO on 14 Feb 2012 worked in an unprotected trench that was six feet deep to install a new home water service.      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

(a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(DESCRIBE HAZARD(S) WHERE NECESSARY, WHAT PRECAUTIONS THE EMPLOYER WAS LACKING, AND CAUSE OF THE WATER ACCUMULATION)          An employee at the job site located at 2378 Spring Mill Estates Drive in St. Charles MO on 14 Feb 2012 worked in a tench which was five feet deep and contained standing water.  The water was actively pouring into the trench as the work continued.        Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).
