29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities shall be in near proximity to the worksite and shall be so equipped as to enable employees to remove such substances: On or about April 12, 2012, during construction brick laying activities, the employer did not provide adequate washing facilities in near proximity to the worksite. NOTE: ANSI Z358.1-1990 5.4.4: Eyewash units shall be in accessible locations that require no more than 10 seconds to reach from the hazard.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: On or about April 12, 2012, during construction brick laying activities, the employer did not ensure that appropriate PPE was provided, effectively used, and maintained. The employer did not ensure that gloves and eye protection, such as safety glasses with side shields or goggles were provided. The employer did not ensure such equipment was maintained in a sanitary and reliable condition when not in use, and employees were able to clean or exchange their equipment.
