29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exis (a)(LOCATION)(IDENTIFY THE HAZARDOUS CONDITION AND THE DEFICIENT ACTION) A worker fell through an improperly guarded floor hole ten feet to the lower level where an inspection of the jobsite had not been conducted by a competent person.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). 1. A worker fell ten feet through a floor hole to the lower level which was not adequately covered. 2. Workers were exposed to falls up to fifteen feet to the ground below through window openings that were not properly guarded.
