29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    Throughout the workplace: On 05/01/2012, the employer did not develop nor implement a written hazard communication program for employees exposed to hazardous chemicals while engaged in workplace activities. Employees who performed workplace activities were exposed to potential injuries from contact with the following hazardous chemicals such as, but not limited to, Auto-Chlor Roomsense 100 & 400, Auto-Chlor Roomsense 400 Tub and Tile Cleaner, and Auto-Chlor Glass Kleen Concentrate.

Throughout the workplace: On or about 05/08/2012, the employer did not provide an OSHA poster in the workplace for inspection and review by employees engaged in workplace activities.

29 CFR 1904.4(a):     The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. Abatement Certification and Documentation is required.    Throughout the workplace: On 05/08/2012, the employer did not record the following workplace injuries or illnesses on the OSHA Form 300 or equivalent for the calendar year 2012. The employee, while engaged in workplace activities, sustained a work-related injury on 04/26/2012; and was treated at the Emergency Department of the McAllen Medical Center.
