29 CFR 1910.1001(j)(2)(i):  Employers and building and facility owners did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos containing material (ACM) and presumed asbestos containing material (PACM):    a) Basement inside storage room 1- The employer did not inform workers performing housekeeping operations about the presence and location of ACM and/or PACM.  Workers are required to maintain floors and associated tiles which which were found to contain 4% asbestos.  Condition noted on or about 05/03/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.1001(j)(4)(i): Warning labels shall be affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers.     a) Basement inside storage room 1    The employer did not affix asbestos warning labels where ACM was present to include insulated piping and floor tiles.  Bulk samples of floor tiles were found to contain 4% asbestos.  Condition noted on or about 05/03/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.1001(j)(7)(iv): The employer did not provide, at no cost to employees who perform housekeeping operations in an area which contains ACM or PACM, an asbestos awareness training course.     a) Basement inside storage room 1    The employer did not train employees who are required to perform housekeeping operations such maintaining floors and associated tiles in the hazards associated with asbestos.   Bulk samples taken of flooring tile was found to contain 4% asbestos.  Condition noted on or about 05/03/12.    ABATEMENT NOTE:    AWARENESS LEVEL TRAINING SHOULD INCLUDE HEALTH EFFECTS OF ASBESTOS, LOCATIONS OF ACM AND PACM IN THE BUILDING/FACILITY, RECOGNITION OF ACM AND PACM DAMAGE AND DETERIORATION, REQUIREMENTS IN THE STANDARD RELATING TO HOUSEKEEPING, AND PROPER RESPONSE TO FIBER RELEASE EPISODES, TO ALL EMPLOYEES WHO PERFORM HOUSEKEEPING WORK IN AREAS WHERE ACM AND/OR PACM IS PRESENT.  EACH EMPLOYEE SHALL BE SO TRAINED AT LEAST ONCE A YEAR.      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.
