OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a possible entrapment of the head and torso between the forklift and the floor or other surface while operating the forklift should a tip-over of the forklift occur.  One feasible and acceptable abatement method to correct this hazard is to provide an operator protection (restraint) device on the forklift such as seat belts.
