29 CFR 1910.1030(h)(5)(i): The employer did not establish and maintain a sharps injury log for the recording of percutaneous injuries from contaminated sharps: a) Atrium Living Centers, Inc. dba Woodside Village Care Center - Mt. Gilead, Ohio: On or about May 14, 2012, the employer failed to establish and maintain a sharps injury log. A log that protected an employees identity and included the type and brand of device involved in the incident, the work area where the exposure incident occurred and an explanation of the incident occurred was not maintained. At least three percutaneous injuries were not recorded on a sharps injury log. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Gilead, Ohio: On or about May 14, 2012, the employer failed to assure that the exposure control plan included a list of all tasks and procedures or groups of related tasks and procedures in which occupational exposure occurs in job classifications 8810 and 8829. Atrium Living Centers, Inc. dba Essex of Springfield was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1030(c)(1)(ii), which was contained in OSHA Inspection Number 312442791, citation number 2, item number 1, and was affirmed as a final order on September 23, 2008, with respect to a workplace located at 2317 E. Home Rd., Springfield, OH 45503. Gilead, Ohio: On or about May 14, 2012, the employers annual review and update of the exposure control plan did not contain at least the elements in 29 CFR 1910.1030(c)(1)(iv)[A] through (c)(1)(iv)[B]. The review did not reflect changes in technology for safer needles that would eliminate or reduce exposure to bloodborne pathogens and did not document consideration and implementation of available and safer medical devices. Atrium Living Centers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1030(c)(1)(iv), which was contained in OSHA Inspection Number 312965932 citation number 1, item number 1, and was affirmed as a final order on March 10, 2009, with respect to a workplace located at 6973 Pearl Rd., Cleveland, OH 44130. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
