On or about May 8, 2012 and prior thereto, the Par Fry break room exit door could not be opened without tripping a photo eye mounted above the door or pushing a button on the left side of the door to release the lock. b. On or about May 8, 2012 and prior thereto, the Shipping Department exit door could not be opened without tripping a photo eye mounted above the door or pushing a button on the left side of the door to release the lock.

29 CFR 1910.36(d)(2): Exit route doors were operated by a device or alarm that could restrict emergency use of the exit route if the device or alarm fails: a. On or about May 8, 2012 the photo eye used to unlock the Par Fry break room exit door as employees walked to the door failed. Employees pushed a button located on the left side of the door to release the lock. In the event that the photo eye or the push button failed, the door would not unlock. This condition exposed employees exiting the facility to the hazard of not being able to immediately exit in the event of an emergency such as fire or ammonia release. b. On or about May 8, 2012, the Shipping Department exit door could not be opened without tripping a photo eye that allowed the door to open or push a button on the left side of the door to release the lock. In the event the photo eye or the push button failed, the door would not unlock. This condition exposed employees exiting the facility to the hazard of not being able to immediately exit in the event of an emergency such as a fire or ammonia release.
