29 CFR 1926.453(b)(2)(v):     A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    On or about May 14, 2012, employees were working from an ariel lift without fall protection exposing the employees to a fall hazard of greater than 25 feet.    There is no abatement certification or documentation required for this item.

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about May 14, 2012, an employee was working on a roof performing stucco work without fall protection exposing the employee to a fall hazard of greater then 25 feet.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19 (d).

29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    On or about May 14, 2012, employees were working with stucco which contained silica and other chemicals without the company proving a HAZCOM program exposing employees to the hazards of not knowing what materials they are working with.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19 (d).
