OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust explosion or deflagration hazards as a result of working at or near dust collection systems, handling combustible dust generated from a metal polishing process, which were not designed to prevent or minimize employee exposure in the event of a dust explosion and/or deflagration event: The seven indoor Air America media-type dust collectors located within the Polishing Department lacked methods of explosion protection and deflagration propagation protection: a) Polish Robot, Model # DF12, Serial # 9909-750; upper level b) North, Model # DFC12-2, Serial # 9903-650; upper level, servicing small auto polish c) Middle, Model # DFC12-2, Serial # 9906-718; upper level, servicing large auto polish d) South, Model # DFC12-2, Serial # N/A; upper level, servicing large auto polish e) North Hand Jack, Model # DFC12, Serial # N/A; upper level f) South Hand Jack, Model #DFC-12, Serial # N/A; upper level g) Hand Jack lower level DFC 12, S/N 9909-752.
