29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a) In the warehouse, on or about and at times prior to May 15, 2012, the employer did not remove from service forklift number 5 that had a failed rear light, that was operated by an employee performing the task of loading trailers, exposing the employee to the hazards associated with bruises, scrapes, and minor lacerations. ABATEMENT CERTIFICATION IS REQUIRED
