29 CFR 1910.23(c)(1):     Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toe board wherever, beneath the open sides,    Throughout Facility - On or about May 15, 2012, the employer failed to provide a standard railing on all open sides of a floor, thereby exposing employees to 9 feet 10 inch falls.

29 CFR 1910.24(b):     "Where fixed stairs are required." Fixed stairs shall be provided for access from one structure level to another where operations necessitate regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations.     Throughout Facility - On or about May 15, 2012, the employer failed to provide fixed stairs when access to elevations is daily, thereby exposing employees to falls.

Throughout facility - On or about May 15, 2012, an evaluation of powered industrial truck operators was not performed at least once every three (3) years, thereby exposing employees to struck by hazards.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    Throughout facility - On or about May 15, 2012, the employer did not perform an examination of the Toyota truck, model number 7FBCU25, to check for defects after each shift, thereby exposing employees to struck by hazards.

The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report.    Recordkeeping - On or about May 15, 2012, the employer did not keep OSHA logs, OSHA summaries or OSHA 301 forms for the last three (3) years.
