OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. Entire Facility - On or about May 15, 2012, employees worked at 10 foot heights from a pallet which was supported by the forks of a powered industrial truck, Crown serial number 1A191438 in order to clean the plastic on door jambs. The employer failed to implement adequate procedures, thereby employees were exposed to falls of ten (10) feet to the ground.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. Throughout facility - On or about May 15, 2012, the employer did not perform an examination of the Toyota and Crown trucks, serial numbers 31307, D723681 and 1A191438, to check for defects, thereby exposing employeexs to struck by hazards.
