29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:      a) There was no frequent and regular inspection program being maintained in use by a competent person to ensure the jobsite, materials and equipment such as walking / working surface holes and unprotected side or edge fall protection systems and / or devices were being maintained and utilized in a  safe condition.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      a) Located along and adjacent to an unprotected side or edge of the commercial / restaurant roof deck structure employee(s) were observed performing framing associated sheeting operations without conventional fall protection devices or systems and were exposed to fall potentials in excess of 14'.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.        a) Located along various areas of the commercial / restaurant roof deck structure employees were observed working adjacent to a minimum three unprotected walking / working surface holes ranging in approximate size from 7'x4'9", 40"x77" to 81"x8' exposing employees to fall potentials thorugh the holes in excess of 13'.
