OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the working bucket of the excavator being held together by a job-made piece of rebar instead of a pin approve for this purpose. (a) DMWR Fagatogo Dock surface repair On 24 April 2012 and at times prior thereto, the workers were observed working and walking near the excavator which was being used to move rocks and dirt on the dock surface. Regular rebars were cut to fit and used as pins for the working bucket or the shovel of the excavator instead of pins originally provided by the manufacturer, to secure the bucket. Slippage of the coupling could result in unintended separation of the bucket during operation, potentially striking or injuring the workers.
