29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    (a) Jobsite:  On or about May 17, 2012, three employees were working (tearing off the old asphat shingled roof and replacing it with a new one) from a residential roof and they were not protected from falling from the roof.  The fall hazard ranged from approximately 8 1/2 feet to 20 feet from the 7 in 12 pitch roof.    C & A Ochoa Contracting was previously cited for a violation of this occupational safety and health standard and or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 315562645, citation number 1, item number 1 and was affirmed as a final order on 12/13/2011.
