29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.      On or about May 17, 2012, employees installing siding on or near a six (6) tier tubular welded frame scaffold that was not equipped with toeboards were exposed to being struck by falling objects such as tools and/or materials.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.        On or about May 17, 2012, employees installing siding from a (6) tier tubular welded frame scaffold did not have acceptable access to the upper levels of the platform. The employees were exposed to falls of up to (33) feet to the ground.

CFR 1926.453(b)(2)(v) A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).        On or about May 17, 2012, an employee working from aerial lift was not utilizing fall protection. Employee was exposed to a fall of more than (18) feet to the ground.

On or about May 17, 2012, employees performing siding installation activities while working from a 6:12 pitch roof were exposed to fall hazards of (40) feet to the ground below.
