29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) Custom Edge Marble & Granite LLC, 710 Umatilla St., Denver, CO 80204: On and before 5/17/12, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to:    	(1) Acetone  	(3) Granite (containing respirable crystalline silica)        	      Abatement note:  The written hazard communication program will also include:    (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.

The employer provided and required the use of MSA half-mask elastomeric respirators with P100 filters when working in the fabrication area.      Abatement note: The written program shall include at least the following:                                                                                                                        (1)  Procedures for selecting respirators for use in the workplace;                                                                                                                         (2)  Medical evaluations of employees required to use respirators;                                                                                                                          (3)  Fit testing procedures for tight-fitting respirators;                                                                                                                                  (4)  Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;                                                                                                                                                                                                                    (5)  Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators;                                                                                                                          (6)  Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators;                                                                                                                                                  (7)  Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;                                                                                                                                       (8)  Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and                                                                                                                 (9)  Procedures for regularly evaluating the effectiveness of the program.

Abatement note: The employer shall ensure that each employee who uses a respirator can demonstrate knowledge of at least the following:    (a)	Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator;  (b)	What the limitations and capabilities of the respirator are;  (c)	How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions;  (d)	How to inspect, put on and remove, use, and check the seals of the respirator;  (e)	What the procedures are for maintenance and storage of the respirator;  (f)	How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators; and  (g)	The general requirements of this section.
