OSH Act of 1970 Section (5)(a)(1):        The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to casue death or serious physical harm to employees in that employees are exposed to a struck-by hazard due to the removal of the truck's anti-two block system.      a.  At the workplace on or about May 25, 2012, the employer did not ensure that the anti-two block system was operational. The anti-two-block system's removal exposed employees to a struck-by hazard due to cut tree sections free falling if two-blocking occured.

29 CFR 1910.180(d)(2):     "Regular inspection." Inspection procedure for cranes in regular service is divided into two general classifications based upon the intervals at which inspection should be performed. The intervals in turn are dependent upon the nature of the critical components of the crane and the degree of their exposure to wear, deterioration, or malfunction. The two general classifications are herein designated as "frequent" and "periodic", with respective intervals between inspections as defined below:    29 CFR 1910.180(d)(2)(i):     Frequent inspection: Daily to monthly intervals.          a. At the workplace, on or about May 25, 2012, it was found that inspection records which include the date of inspection, the signature of the person(s) who performed the inspection and the serial number of the crane could not be produced by the employer.

29 CFR 1904.29(b)(3):     How quickly must each injury or illness be recorded? You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.          Located at Schmitt Tree Experts in Columbus, Ohio:    a.  The employer did not record a recordable injury within seven calender days on the 2012 OSHA 300 log which resulted in days away from work that occurred on April 27, 2012.
