29 CFR 1910.178(l)(1)(ii):     Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    a.    On the construction site in Heath, Ohio where framing was performed, the employer did not have a trained powered industrial truck operator operating the forklift thereby exsposing employees to a struck-by hazard.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a.     On the south side o the building beinf framed, employees were observed walking the top plate and did not use alternative means of fall protection thereby exposing employees to a fall hazard.

29 CFR 1926.1053(b)(1):     When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a.     On the south side of the building the employer used a 8 foot step ladder for employees to gain access to a 12 foot top plate wall to perform framing therebybexposing the employees to a fall hazard.

On the south side of the building where employees used an 8 foot step ladder to gain access and exit the top of the framed buiding, the employees used the top step of the ladder as it was leaning up against the wall thereby exposing employees to a fall hazard.
