Wagner Co. on or about May 18, 2012, at the I-475 construction site near the Sherbrooke Rd. Bridge in Toledo, OH: The employer failed to ensure employees making a water supply connection atop the north abutment of the pedestrian bridge were adequately protected from falls. Employees were exposed to falls up to 12 to the level below.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement. (a) E.S. Wagner Co. on or about May 18, 2012, at the I-475 construction site near the Sherbrooke Rd. Bridge in Toledo, OH: The employer failed to ensure reinforcing steel protruding above the walking/working surface was adequately guarded to prevent employee impalement. While prepping concrete formwork prior to a pour, an employee performing these duties above the protruding rebar was exposed to the impalement hazards.
