The bins had ladders installed to gain access to their top hatches at heights greater than 20 feet and there were no cages installed. 29 CFR 1910.27(c)(4): The distance from the centerline of rungs, cleats, or steps to the nearest permanent object in back of the ladder was less than 7 inches, except that when unavoidable obstructions are encountered, minimum clearances as shown in figure D-3 shall be provided: a) On or about May 8, 2012, and times prior, employees were exposed to injuries for falls to the lower surface at the following locations, bins 1,2,3,8,9,11 - 17. The distance from the centerline of the rungs to the bin was less than 7 inches on all the access ladders of these bins. 29 CFR 1910.333(a)(2): If the exposed live parts are not deenergized (i.e., for reasons of increased or additional hazards or infeasibility), other safety-related work practices were not used to protect employees who may be exposed to the electrical hazards involved. Such work practices did not protect employees against contact with energized circuit parts directly with any part of their body or indirectly through some other conductive object. The work practices that are used were not suitable for the conditions under which the work is to be performed and for the voltage level of the exposed electric conductors or circuit parts. Specific work practice requirements are detailed in paragraph (c) of this section: a) On or about May 8, 2012 and times prior, employees were exposed to injuries such as but not limited to electrocution when opening the panel door to gain access to the breaker. After opening the door the employee reached into the energized panel and engages the breaker for the white leg.
