29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were provided but not used. a) On or about 5/18/2012, and at time prior thereto, employees were exposed to Oatey Purple PVC Primer containing Acetone and Meth Ethyl Ketone, a skin and eye irritant, while installing PVC pipes and were not using proper PPE (chemical gloves). b) On or about 5/18/2012, and at time prior thereto, employees were exposed to Uni-Weld PVC Solvent Cement containing Acetone and Meth Ethyl Ketone, a skin and eye irritant, while installing PVC pipes and were not using proper PPE (chemical gloves).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) & (c): a) On or about May 18, 2012 and at times prior thereto, an employee was exposed to the hazards of cave-ins while installing a sanitary sewer line in the second half of a trench with an adjustable beam at or above the line of excavation, contrary to specificed tabular data: "5.2 The center line of the top hydraulic cylinder shall be a minimum of 12 inches and a maximum of 24 inches below the top of the excavation". b) On or about May 18, 2012 and at times prior thereto, employees were exposed to the hazards of cave-ins, in a trench with the approximate dimensions of 6 ft deep, 2 ft wide at base, and 15 ft. wide at excavation line where one half of the trench was unprotected by any means of shoring.
