29 CFR 1926.502(b)(1): Top edge height of top rails, or equivalent guardrail system members, were not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working: a) Job site, 915 Ridge Road, Pittsburgh, PA: On or about May 3, 2012, during construction activities, the employer did not ensure that appropriate fall protection systems or devices were used where workers were exposed to fall hazards of up to approximately 45 feet in that some of the wire cable guardrail systems that were installed along the stairway system openings and the perimeter of the 3rd floor, were not at least 39" in height.

29 CFR 1926.502(b)(4): When the 200 pound (890 N) test load specified in paragraph (b)(3) of this section is applied in a downward direction, the top edge of the guardrail shall not deflect to a height less than 39 inches (1.0 m) above the walking/working level: a) Job site, 915 Ridge Road, Pittsburgh, PA: On or about May 3, 2012, during construction activities, the employer did not ensure that appropriate fall protection systems or devices were used where workers were exposed to fall hazards of up to approximately 45 feet in that some of the wire cable guardrail systems that were installed along the stairway system openings and the perimeter of the 3rd floor were able to be moved below 39" when pushed down/leaned on.
