29 CFR 1910.23(e)(1): The railing did not consist of top rail, intermediate rail, and posts, and did not have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level: a) On or about June 8, 2012, the employer, All-Coast Forest Products, Inc., did not protect employees, who are required to operate the timber re-sizer or perform ancillary duties such as moving re-sized wooden beams, from fall hazards of approximately 10 feet by not ensuring railing consisited of a top rail, mid rail, and posts, and had a vertical height of 42 inches from the upper surface of top rail to platform.
