29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. 1982 Route 70, Cherry Hill, NJ: The controlling employer, PMA Masonry, Inc., had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, B C Stucco & Stone employees onsite were observed working from the top of the welded tubular frame scaffolding with no means of fall protection (PFAS, positioning system, safety nets, guardrails, etc.) and no appropriate means of access to the walking working surface. Employees were exposed to a fall hazard in excess of 25 feet. Observed on or about 05/10/2012. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
